Terms of Service

These Terms of Service ('Terms') govern your use of the WeEdit photo editing service, provided by Insight Photo, a Dutch general partnership (KvK number 85236942, VAT NL863556449B01, registered at Spoorlaan 29, 3645 EK Vinkeveen, Netherlands). By creating an account or using the service, you agree to these Terms.
WeEdit provides an automated, AI-assisted real estate photo editing service. Available edits include sky replacement and colour profile adjustments. The service is delivered as software-as-a-service and is billed using prepaid credits.
You must create an account to use the service. You must be at least 18 years old. You are responsible for the security of your credentials and for all activity under your account. You must provide accurate account information and keep it up to date. Business accounts are created on behalf of an organization; the signing user warrants they are authorized to bind that organization.
You agree not to upload content that is unlawful, infringing, defamatory, or that you do not have the rights or consents to process. In particular, you warrant that you own or are authorised to use each image, and that you have any necessary consents from identifiable individuals or owners of depicted property. You may not attempt to reverse-engineer, disrupt, or gain unauthorised access to the service, nor use it to violate any applicable law. We may suspend or terminate accounts that breach these rules.
The service is billed through prepaid credits purchased via Mollie. Prices are in Euros (EUR) and include any applicable VAT. Credits do not expire while your account is active. We never see or store your card details. Invoices are made available in your account after each payment.
Current prices are shown on our pricing page and at checkout before you complete a purchase. We may change prices from time to time; changes apply only to credits you buy after the change takes effect. Credits already purchased remain usable at their original value.
If you are a consumer in the EU, you have a statutory 14-day right of withdrawal for the purchase of unused credits, starting from the date of purchase. To withdraw, email hello@we-edit.app within 14 days and we will refund the unused credits to the original payment method. Once you use credits to process images, you expressly request immediate performance of the digital service and acknowledge that you lose the right of withdrawal for the credits consumed, in line with Article 16(m) of Directive 2011/83/EU. Unused credits remain refundable within the 14-day window.
You retain all rights to the images you upload. By uploading, you grant us a limited, non-exclusive licence to store, transmit, and process those images solely to deliver the service. You receive the edited outputs for your own commercial use in real estate listings and marketing. We retain all rights in our software, models, editing pipelines, and service infrastructure. AI-generated outputs may include elements (such as skies, textures, or lighting) that are synthesized by third-party models; we make no warranty that such outputs are free of third-party claims and recommend you review outputs before publication.
You will defend and indemnify Insight Photo and its partners against any third-party claims, damages, or costs arising from (a) content you upload in breach of these Terms, (b) your lack of rights or consents for uploaded images, or (c) your use of the outputs in a way that infringes third-party rights. This clause does not limit any statutory consumer rights you may have.
The service is provided 'as is' and 'as available'. To the fullest extent permitted by law, we are not liable for the quality of your original images, for subjective dissatisfaction with AI outputs, for temporary service interruptions, or for indirect or consequential losses (including lost profits, lost listings, or lost opportunities). Our aggregate liability in any 12-month period is capped at the amount you paid us in that period. Nothing in these Terms limits liability for fraud, intentional misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited — including mandatory consumer rights under Dutch and EU law.
You can close your account at any time from your account settings. Unused credits remaining at closure are non-refundable except where the 14-day withdrawal right above applies or where a goodwill refund has been agreed. We may suspend or terminate accounts for material breach of these Terms or for non-payment. If we discontinue the service entirely, we will give you reasonable advance notice and refund the prorated value of any unused credits. Refund requests go to hello@we-edit.app.
We may modify or replace features of the service. We will not materially reduce a feature you have already paid for without either providing an equivalent replacement or refunding the prorated value of the affected credits. We will notify you of material changes by email or in-app notice before they take effect.
On termination or account closure, your right to use the service ends immediately. We will retain and delete data in line with our Privacy Policy (typically permanent deletion 30 days after closure). You are responsible for downloading any outputs you want to keep before closing your account.
These Terms are governed by the laws of the Netherlands, excluding its conflict-of-laws rules. If you are a consumer, you retain the protection of the mandatory consumer-protection laws of the country where you habitually reside.
We would like to resolve any dispute with you directly — please contact hello@we-edit.app first. If we cannot reach agreement, disputes will be submitted to the competent courts of the Netherlands, unless mandatory law assigns jurisdiction elsewhere. EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
